What is EB-5?
The EB-5 is one of the proven paths to US citizenship through an investment in a business on American soil.
The conditions for obtaining a green card include a sizeable investment in a U.S. business with documented evidence of the source of funds and the creation of at least ten new jobs through the U.S. business.
What happened to the EB-5 program earlier?
The EB-5 program has been renewed annually since the program began in 1990. However, at the end of June 2021, the U.S. Congress could not agree on an extension of the EB-5 regional center program, as a result of which the program was frozen indefinitely. More than 90% of EB-5 applications are submitted through the regional center program, so this has effectively shut down an attractive channel for investment immigration to the United States. What has changed now?
On March 10, 2022, the U.S. Senate approved a new budget, the amendments to which included the reauthoritzation of the EB-5 regional center program. After President Biden signs the document in the coming days, the program will again be in force.
New terms for the EB-5 program
The key change to the EB-5 filing requirements is the change in minimum investment amounts. Now, for projects in a territory with a low level of employment, an investor will need to invest a minimum of $800,000. All other projects require an investment starting from $1.05 million.
